Court Updates for Week of July 29, 2024

Austin Morrison: Austin Morrison remains in the custody of the Henry County Jail. Austin Morrison decided to go to trial during his scheduled plea on July 29th. A Final Pre-Trial is scheduled for August 19, 2024, at 9 AM. Jury Trial will be in the week of August 26th. Morrison is charged with Aggravated Battery/Public Place (Class 3 Felony), Resisting (Class 4 Felony), and Domestic Battery/Physical Contact (Class A Misdemeanor) for case 2024CF103. Morrison is charged with Domestic Battery/Physical Contact (Class A Misdemeanor) and Battery/Physical Contact (Class A Misdemeanor) for case 2024CF94. Count One for Aggravated Domestic Battery/Strangle (Class 2 Felony) was dismissed.

Darren Chamberlain: Darren Chamberlain waived the reading of the charges and arraignment on July 30, 2024. A Jury Pre-Trial is scheduled for October 1, 2024, at 10 AM. Darren Chamberlain is charged with Improper Passing/Safe Distance (Class P Other).

Justin Kirchner:  Justin Kirchner remains in custody on a $500,000 (10%) bond. Justin Kirchner changed his mind and didn’t take the plea. Attorney VanDerSnick said there was a little confusion regarding the credit for time served. The State said they remain willing to still negotiate with Kirchner. A Jury Pre-Trial is scheduled for August 15, 2024, at 2 PM. Jury Trial will be the week of September 3rd. Kirchner is charged with two counts of Aggravated Battery/Public Place (Class 3 Felony) for case 2024CF13, Aggravated DUI causing a Death (Class 2 Felony), DUI Any Amount of Drug (Class A Misdemeanor), plus traffic tickets for case 2022CF301, Possession of Meth <5 Grams (Class 3 Felony), Driving on Suspended License (Class A Misdemeanor), plus traffic citations for case 2023CF92, Driving on a Suspended License (Class A Misdemeanor) for case 2023MT28, and Aggravated Fleeing/21 MPH Over (Class 4 Felony), Aggravated Fleeing/2+ Control Devices (Class 4 Felony) and Reckless Driving (Class A Misdemeanor) for case 2023CF238.

Justin Kentner: The State recommended an appropriate IDOC sentence for Mr. Kentner and the Defense recommended probation. A Jury Pre-Trial is scheduled for September 12, 2024, at 9 AM.  Kentner is charged with Aggravated Battery/Public Place (Class 3 Felony) and Obstructing Justice/Destroy Evidence (Class 4 Felony).

Michael Workheiser:  Michael Workheiser remains in the custody of the Henry County Jail. Mr. Workheiser accepted a plea deal on August 1st. Michael Workheiser pleaded guilty to Possession of a Weapon by a Felon for case 23CF306, and the remaining counts were dismissed. Workheiser also admitted to violating his probation for case 22CF216 for Aggravated Battery. He was sentenced to concurrent three years in the Illinois Department of Corrections (IDOC), followed by six months of Mandatory Supervised Release, with day-for-day credit, and credit for time served. He will receive credit for 289 days in jail for 23CF306 and nine days for case 22CF216. He must report within 180 days of release from IDOC to make payment arrangements for the outstanding balance on 22CF216. Workheiser was charged after selling five guns to a confidential source for $1,500 in a controlled purchase with the Kewanee Police Department and the Black Hawk Area Task Force on October 3rd. Case 23CF188 was dismissed as part of the plea deal.

Michael Workheiser was originally charged with Possession of a Controlled Substance (Class 4 Felony) for 23CF188.  Workheiser is charged with Possession of a Firearm by a Felon (Class 3 Felony), Possession of a Firearm with a Defaced Serial Number (Class 3 Felony), and Possession of Methamphetamine (Class 3 Felony) for 23CF306.
