Juan Montemayor: Send to Final Pretrial. A Final Pre-Trial is scheduled for September 23, 2024, at 9 AM. Montemayor is charged with Manufacture/Deliver 900+ Grams Fentanyl (Class X Felony), Possession of a Gun by a Felon (Class 3 Felony), and Aggravated Unlawful Use of A Weapon (Class 4 Felony) for case 2022CF188, Aggravated Battery/Public Place (Class 3 Felony) and Battery/Makes Physical Contact (Class A Misdemeanor) for case 2021CF340 plus various driving violations.
Kaler Deakin: The State did not accept the counteroffer from the Defense. A Final Pre-Trial is scheduled for August 26, 2024, at 9 AM. A Jury Trial could happen as early as September 23, 2024. Deakin is charged with two (2) counts of Aggravated Unlawful Use of a Weapon/Vehicle (Class 4 Felony), two (2) counts of Possession of a Firearm (Class 4 Felony), Violation of Bail Bond (Class A Misdemeanor), Violation of Pretrial Release (Class A Misdemeanor) and Transportation of Alcohol (Class P Other).
Justin Kirchner: Justin Kirchner remains in custody. The defense argued that the defendant should get credit for time service for the aggravated DUI case. Kirchner isn’t being held on the aggravated DUI case. The defense wants Judge Patton to rule that Kirchner is being held on the aggravated DUI case so “he gets full credit for time served.” A Motion Hearing is scheduled for September 9, 2024, at 3:30 PM, to hear the defense motion for credit for time served. A Jury Pre-Trial is scheduled for September 12, 2024, at 3 PM. Judge Patton said this is the last continuance, and cases will start going to trial in October. Kirchner is charged with two counts of Aggravated Battery/Public Place (Class 3 Felony) for case 2024CF13, Aggravated DUI causing a Death (Class 2 Felony), DUI Any Amount of Drug (Class A Misdemeanor), plus traffic tickets for case 2022CF301, Possession of Meth <5 Grams (Class 3 Felony), Driving on Suspended License (Class A Misdemeanor), plus traffic citations for case 2023CF92, Driving on a Suspended License (Class A Misdemeanor) for case 2023MT28, and Aggravated Fleeing/21 MPH Over (Class 4 Felony), Aggravated Fleeing/2+ Control Devices (Class 4 Felony) and Reckless Driving (Class A Misdemeanor) for case 2023CF238.
Dillon Schilling: Schilling waived a reading of the charges and formal arraignment on the new allegation in the petition to revoke probation. A Motion on Supplemental Petition is scheduled for September 23, 2024, at 11:30 AM. Dillon Schilling is charged with three counts of Felon in Possession of a Firearm (Class 3 Felony), Leaving the Scene of an Accident (Class A Misdemeanor), Failure to Notify Damaged/Unattended Vehicle (Class A Misdemeanor), Failure to Give Notice of a Crash (Class P Other), Transportation of Alcohol by a Driver (Class P Other), Improper Lane Usage (Class P Other) and No Seatbelt (Class P Other).

Robert Mazo is charged with Cannabis Trafficking > 5,000 Grams (Class X Felony), Delivery of Cannabis > 5,000 Grams (Class X Felony), and Unlawful Possession of Cannabis > 5,000 Grams (Class 1 Felony).
Pedro Arreola: Pedro Arreola appeared via Zoom. Both defense attorneys intend to file motions. A Motion Hearing is scheduled for November 20, 2024, at 1 PM. Pedro Arreola is charged with Cannabis Trafficking > 5,000 Grams (Class X Felony), Delivery of Cannabis > 5,000 Grams (Class X Felony), and Unlawful Possession of Cannabis > 5,000 Grams (Class 1 Felony).
Nicklaus Smith: Nicklaus Smith accepted a plea deal on August 15, 2024. He pleaded guilty to intimidation/physical harm, possession of meth, and aggravated unlawful use of a weapon. He was sentenced to 30 months of probation, 180 days in the Henry County Jail, with day-for-day credit and credit for times served, obtain a substance abuse evaluation and recommended treatment, not allowed to possess alcohol or controlled substances, no contact with the victim, submit a DNA sample and pay the associated fee, and a $75 plus assessments. The defendant said he has a FOID card, but does not have a concealed carry license.
On February 1, 2024, the Kewanee Police Department was dispatched to EZT Gaming on East Third Street for a man who was forcing him to withdraw money. The victim told police the man’s name was Nicklaus and he had a silver revolver with him. The victim said he had been with Nicklaus and a second person for most of the day, and they had gone to places to gamble. The victim said they were at a residence on Florence Street, and he left when three individuals there were showing each other their pocket knives. The victim was at the Cenex Gas Station when Nicklaus pulled up and told the victim he would punch him if he didn’t get in the vehicle. Once he was in the vehicle, he said Nicklaus drove next door to EZT Gaming and Nicklaus pulled out a silver revolver and pointed it at him. The victim said Nicklaus told him to go inside and withdraw $100, originally told him $50. The victim said he went inside and called the police. Officers arrived and located Nicklaus and the second person. Officers found a Smith & Wesson silver revolver, five rounds of ammunition, and a substance that field tested positive for methamphetamine.
Smith is charged with Armed Violence with a Gun (Class X Felony), Aggravated Robbery (Class 2 Felony), Intimidation (Class 3 Felony), Possession of Meth <5 grams (Class 3 Felony), Aggravated Unlawful Use of a Weapon (Class 4 Felony), Aggravated Assault/Public Property (Class A Misdemeanor), and Aggravated Assault/Deadly Weapon (Class A Misdemeanor) for case 2024CF32.

The murder trial against a Colona man for the death of his 14-month-old daughter has been delayed again. The bench trial scheduled for the end of September has been removed from the trial schedule. A Final Pre-Trial and Bench Trial will be rescheduled through court admin.
Rahsaan Strawder is charged with 2 counts of First Degree Murder (Class M Felony), 2 counts of Aggravated Battery to a Child Under 13 (Class X Felony), and Aggravated Battery (Class 3 Felony). Mr. Strawder is alleged to have battered a 14-month-old female child, causing her death on January 27, 2022.
