Illinois Law Protects Employees Using Work Devices to Document Domestic or Gender Violence

Illinois workers now have new legal protections when using company devices to document incidents of domestic, sexual, or gender violence. Public Act 104-0171, which became effective on January 1st, prohibits employers from disciplining or retaliating against employees who use work-provided phones, computers, or other devices to record evidence related to such violence affecting themselves or their families. Supporters of the law say it creates a crucial safety net for individuals seeking to gather proof or report abuse, ensuring that their jobs are not at risk as they seek help or protection. Employers are advised to update relevant policies accordingly.

“This change recognizes the realities that victims of violence face during moments of crisis,” said IDOL Director Jane Flanagan. “No one should have to choose between their safety and their job when documenting violence against themselves or their family.”

Illinois workers seeking information on their leave entitlements now have direct access to the Leave Rights Division. The agency is responsible for administering laws such as VESSA, the Paid Leave for All Workers Act, the Child Extended Bereavement Leave Act, the Employee Sick Leave Act, and the Family Bereavement Leave Act.
