Kewanee Man Facing Additional Possession of Child Porn if he Doesn’t Accept Plea Deal

A Kewanee man has a decision to make after the outcome of the 402 (d) conference on August 13, 2024. Thomas Motley faces 10 counts of possession of child pornography and one count of unlawful use of a weapon. State’s Attorney Runty said that there are 26 items related to child pornography in discovery. She said the state would file 11 additional counts of possession of child pornography if Mr. Motley didn’t accept the plea on the table. The state offered a plea for a total of 6 to 8 years in the Illinois Department of Corrections (IDOC). Possession of child pornography charges are served consecutively. The state said that the discovery is of images of children and videos of children.  The defendant is not in any of the images, nor did he produce any of the media. The defense is recommending probation and not prison because the defendant has no criminal history. Motley is currently on suspension from his job with the Department of Corrections, but he won’t be able to return to his job if he’s convicted of a felony. Motley had to sell his house due to financial hardships, and he lives with his parents now. He has the support system to be successful on probation. Defense Attorney Miljush said that Motley has attended all of his court hearings and will comply with probation. “I believe in him,”  said Mr. Miljush, “I believe his family will help him.”

Judge Terry Patton said that child pornography is a serious offense. He said that these kids are victimized every time someone views it for their own sexual pleasure. Judge Patton pointed out that some of the videos were with penetration, and some were with a child posed and naked. The weapons charge is because Mr. Motley does not have a concealed carry license. Judge Patton said, “I find myself more in agreement with Ms. Runty.” Judge Patton said that a prison sentence is warranted.

A Jury Pre-Trial is scheduled for September 12, 2024, at 3 PM. A Jury Trial would be during the week of November 7th. Judge Patton said the parties need to find a resolution or set for a trial. Thomas Motley is charged with ten (10) counts of Possession of Child Pornography/Victim Under 13 (Class 2 Felony) and Unlawful Use of a Weapon (Class A Misdemeanor).
