Ashton Powers:  Ashton Powers remains in custody on a $100,000 (10%) bond.  Defense Attorney Camp said he needs time to review the Discovery.  The Jury Pre-Trial was continued to January 19, 2023, at 9 AM.  Powers is charged with two (2) counts of Unlawful Use or Possession of Weapons by a Felon (Class 3 Felony), Reckless Discharge of a Firearm (Class 4 Felony) and Aggravated Assault (Class 4 Felony).  A Jury Pre-Trial is scheduled for December 22, 2022, at 9 AM.  Read more on the case here.  Update: Powers had a Motion to Reduce Bond or Release on Own Recognizance on December 28th.  The Motion was denied.  Bond remains the same.

Dale English:  Dale English initially did not appear for his hearing.  The Jury Pre-Trial was changed to 9 AM at the request of the Defense.  English did appear at the original 11 AM hearing.  Defense Attorney Miljush and his client are considering the offer received from the State.  Judge Cosby said there are not many continuances left.  The Jury Pre-Trial was continued to February 23, 2022, at 11 AM.  English is charged with Predatory Criminal Sexual Assault Victim under 13 (Class X Felony) and Aggravated Criminal Sexual Abuse Victim under 13 (Class 2 Felony). Brandon Swank:  Brandon Swank remains in custody of the Henry County Jail on a $75,000 (10%) bond.   Brandon Swank has agreed to the plea offer from the State.  A Plea hearing is scheduled for December 28, 2022, at 1:30 PM.  Swank was charged with Possession of a Weapon by a Felon (Class 3 Felony), Possession of less than 5 Grams Meth (Class 3 Felony) and Possession of Drug Paraphernalia (Class A Misdemeanor).  Read details about the case here.

Samantha Engholm:  Attorney Bruce Carmen was recently retained by Engholm.  Attorney Carmen said he hasn’t received discovery or an offer from the State.  The Jury Pre-Trial is continued to January 19, 2023, at 1 PM  Engholm is charged with Fleeing and Eluding (Class 4 Felony), Aggravated Fleeing and Eluding (Class 3 Felony), Reckless Driving (Class A Misdemeanor) and numerous traffic offenses.  She posted bond and was released on November 28th.  Read more here.

Melcon DeJesus:  Melcon DeJesus remains in custody of the Henry County Jail on $500,000 (10%) bond.  Defense Attorney Dyer was covering for Attorney Clark Miljush and said they are still waiting on DNA results.  State’s Attorney Runty anticipates the lab will have the labs back in January.  The Jury Pre-Trial is continued to January 19, 2023, at 10 AM.  DeJesus is charged with Four (4) counts of Predatory Criminal Sexual Assault of a Child under 13 (Class X Felony).  Read more here.

Nicholas Smith:  Nicholas Smith remains in custody of the Henry County Jail on a $25,000 (10%) bond.  Defense Attorney Dyer said he needs time to meet with his client.  A Jury Pre-Trial is scheduled for January 19, 2023, at 10 AM.  Smith is charged with Aggravated Battery (Class 3 Felony), Battery (Class A Misdemeanor) and Violation of Order of Protection (Class A Misdemeanor).  Read more here.

Tyler Westefer:  Tyler Westefer remains in custody of the Henry County Jail on $75, 000 (10%), $250,000 (10%) and $1,000,000 (10%) bonds for cases 22CF23822CF315 and 22CF337.  Defense Attorney requested the $5,000 bond be surrendered so it can be returned to Tyler’s Grandfather.  Judge James Cosby said the bond can’t be returned and Attorney Paulson must submit a motion to surrender the bond.  A Jury Pre-Trial is scheduled for January 19, 2022, at 1 PM.  Read more here.

Scott English: Scott English remains in custody of the Henry County Jail on a $250,000 (10%) bond.   Attorney Camp said he needs a little more time to work on the case.  He is working on an offer from the State. The Jury Pre-Trial is Continued to January 19, 2023, at 11 AM.  Scott English is charged with two counts of Predatory Criminal Sexual Assault/Victim under 13 years of age (Class X Felony) and two counts of Aggravated Criminal Sexual Abuse Victim is a family member under 18 (Class 2 Felonies). Richard McDonald:  Richard McDonald remains in custody of the Henry County Jail on a $150,000 (10%) bond.  Defense Attorney Camp requested the case be set for Final Pre-Trial.  Final Pre-Trial is set for January 17, 2022, at 9 AM.  McDonald is charged with Making Terrorist Threats (Class X Felony), two violations the Sexual Offender Registration Act (Class 3 Felonies).  Read more here.

William Keller:  William Keller remains in custody of the Henry County Jail on a $75,000 (10%) bond.  A plea offer was presented to Mr. Keller last month.  The Defense and State are very close to an agreement.  Keller wants more time to review the offer.  The Jury Pre-Trial is continued to January 19, 2022, at 11 AM.  Keller is charged with Aggravated Criminal Sexual Abuse – Victim under 13 years of age and Aggravated Criminal Sexual Abuse – Victim is a family member under 18 years of age.  Both are Class 2 Felonies.  Read more on the case here.

Jason Ader:  A Plea agreement has been made.  Mr. Ader is a college student and the Defense requested a plea hearing be scheduled for a later date and Mr. Ader be allowed to serve his jail sentence during summer break from school.  A Plea Hearing is scheduled for March 17, 2023, at 1 PM.  Jason Ader will report to the Henry County Jail when the Spring Semester of College is done.  Ader is charged with Aggravated Battery of a Peace Office (Class 2 Felony), Aggravated Assault with a Motor Vehicle (Class 4 Felony) and Reckless Driving (Class A Misdemeanor).  Read details about the case here.

Rodney Smith:  Rodney Smith remains in the custody of the Henry County Jail on a $25,000 (10%) bond.   Attorney Dyer said he is new to the case and needs time to meet with his client.  The State handed Attorney Dyer an offer and Attorney Dyer said Mr. Smith would likely be interested in the offer.  Rodney Smith was transported back to the courtroom from jail to discuss the offer with Mr. Dyer.  Rodney Smith accepted the plea deal and the paperwork was completed and signed.  However, there is an issue with living arrangement so a plea hearing will be scheduled for the week after Christmas.  Rodney D Smith is charged with Aggravated Battery/Victim 60+ (Class 3 Felony), Aggravated Battery in a Public Place (Class 3 Felony) and two counts of Domestic Battery/Physical Contact (Class A Misdemeanor).  Smith is charged with Aggravated Battery of a Child under 13/Bodily Harm (Class 3 Felony), Domestic Battery/Bodily Harm (Class A Misdemeanor) and Resist Peace Officer ( Class A Misdemeanor).  Read details about the case here.

Matthew Peed:   Matthew Peed did not appear in court.  He appeared by phone on Defense Attorney Carmen’s phone.  Defense Attorney Carmen said he sent a counter offer to the State.  He still has some discovery to review.  Assistant State’s Attorney Reynolds reminded Mr. Peed that he was ordered to find employment and start contributing to the money owed for Electronic Home Monitoring.  Matthew Peed said he has put in 8 applications.  The Jury Pre-Trial is continued to February 23, 2022, at 1 PM.  Matthew Peed is charged with Aggravated Battery by Firearm Discharge (Class 1 Felony), Aggravated Battery in a Public Place (Class 3 Felony), Reckless Discharge of a Firearm (Class 4 Felony) and Aggravated Assault (Class 3 Felony).  Read details about the case here.

Christopher Evans:  Christopher Evans remains in custody on a $75,000 (10%) bond.  Defense Attorney Dyer requested the case be sent to Final Pre-Trial.  The Final Pre-Trial is scheduled for January 17, 2023, at 9 AM. Read details on the case here.  Christopher Evans is charged with Failure to Report an Injury Accident (Class 2 Felony), Aid/ABET/Possession of a Stolen Vehicle (Class 2 Felony), Aggravated Fleeing (Class 4 Felony) and Resisting a Peace Officer (Class A Misdemeanor).

Bradley Simmons:  Bradley Simmons remains in custody on a $200,000 (10%) bond.   Attorney Dyer was recently appointed counsel for Simmons and needs time to meet with his client and review discovery.  There is a great deal of discovery to review.  The Jury Pre- Trial is continued to January 19, 2023, at 10 AM.  Simmons is charged with Possession of Methamphetamine 5-15 grams (Class 2 Felony), Possession of Methamphetamine 5-15 grams with Intent to Deliver (Class 2 Felony), Delivery of less than 5 grams of Methamphetamine (Class 2 Felony) and Resisting a Police Officer with Injury (Class 4 Felony).  Read more here.

Isabel Garcia:  Isabel Garcia was scheduled to appear in-person but appeared by Zoom.  Defense Attorney Hanna appeared by Zoom as well.  Attorney Hanna said he received an offer from the State and needs time to review the offer with his client.   The Jury Pre-Trial is continued to February 23, 2023, at 1 PM.  Isabel Garcia is charged with Trafficking a Controlled Substance (Class X Felony), Manufacture/Delivery of 15 to 100 grams of Fentanyl (Class X Felony) and Possession of a Controlled Substance (Class 4 Felony).  Read more here.

Amanda Robinson:  Amanda Robinson did not appear in court.  Defense Attorney Bruce Carmen said his client couldn’t get a ride to court and she doesn’t have email to receive a Zoom link.  Ms. Robinson called the courthouse to report that she didn’t have a ride to Cambridge for court.  Amanda Robinson is charged with Delivery of  Meth <5 Grams (Class 2 Felony) and Possession of Meth <5 Grams (Class 3 Felony) for case 2022CF297.  She has new charges for Delivery of Meth <5 Grams (Class 2 Felony) and Possession of Meth <5 Grams (Class 3 Felony) for case 2022CF321.  The Jury Pre-Trial and First Appearance are continued to January 19, 2023, at 1 PM.  The clerk was instructed to send a summons to Ms. Robinson.  Read more here.

Michael Anderton: Defense Attorney Bruce Carmen said they have reached an impasse with the State and requested the case be set for Final Pre-Trial.  A Final Pre-Trial is scheduled for January 17, 2022, at 9 AM.  Michael Anderton was charged with Reckless Discharge of a Firearm (Class 4 Felony), Reckless Conduct ( Class A Misdemeanor) and Possession of a Firearm without a valid FOID (Class A Misdemeanor).  Read more on the case here.
