Court Updates from March 13th and 14th, 2023

Preston Atkisson:  Preston Atkisson remains in custody on a $1,000,000 (10%) bond.  Atkisson waived his Preliminary Hearing and Formal Arraignment on March 13, 2023.  Atkisson pleaded Not Guilty to the new charges and a Jury Pre-Trial is scheduled with the pending cases on March 23, 2023, at 1 PM.

Atkisson is charged with Aggravated Battery of an EMT (Class 3 Felony), Criminal Sexual Abuse (Class 4 Felony), Resisting a Peace Officer (Class A Misdemeanor) and Assault (Class C Misdemeanor) for case 2022CF144.   Atkisson is charged with two (2) counts of Criminal Trespass to Residence with Persons Present (Class 4 Felony) for case 2022CF43.  Atkisson is charged with Threatening a Public Official (Class 3 Felony), Aggravated Assault of a Process Server (Class 4 Felony), Battery/Physical Contact (Class A Misdemeanor) and Batter/Cause Bodily Harm (Class A Misdemeanor) for case 2023CF22.  Atkisson is charged with Aggravated Criminal Sexual Abuse/Victim unnder 13 (Class 2 Felony) 2023CF67.  Read more here.

Nickolus McPherson:  UPDATE – McPherson is scheduled for a plea hearing on May 9, 2023, at 10 AM.  He will turn himself in to the Henry County Sheriff’s Office on May 9th.

Defense Attorney Theresa Sosalla continued the 402 Conference to March 29, 2023, at 10:30 AM on behalf of her client.  Judge Jennifer Kelly is covering Judge Terry Patton’s courtroom part of this week.  McPherson is charged with Obstructing Justice (Class 4 Felony), Resisting a Peace Officer (Class 4 Felony) and Resisting (Class A Misdemeanor) for case 22CF162.  McPherson is charged with Possession of a Controlled Substance (Class 4 Felony) for case 21CF251.  McPherson is charged with Possession of Meth <5 grams (Class 3 Felony) for case 21CF195.  Read more here.

Justin Kirchner:  Attorney VanDerSnick continued the Motion Hearing from March 14, 2023, to April 14, 2023, at 11 AM because there is a Judge covering Judge Patton’s courtroom part of this week.  State’s Attorney Runty filed a Motion to Dismiss Attorney Vandersnick’s Motion to Rescind the Statutory Summary Suspension.  The State also filed a Petition to Revoke Bail Bond for Mr. Kirchner.  Kirchner is charged with Aggravated DUI causing a Death (Class 2 Felony).  Read more here.
