Court Updates from March 29th and March 30th, 2023

Nickolus McPherson: A Plea Hearing is scheduled for May 9, 2023, at 10 AM. As part of the plea agreement, McPherson will turn himself in to the Henry County Sheriff’s Office on May 9th to begin serving a jail sentence. McPherson is charged with Obstructing Justice (Class 4 Felony), Resisting a Peace Officer (Class 4 Felony) and Resisting (Class A Misdemeanor) for case 22CF162. McPherson is charged with Possession of a Controlled Substance (Class 4 Felony) for case 21CF251. McPherson is charged with Possession of Meth <5 grams (Class 3 Felony) for case 21CF195. Rahsaan Strawder: Rahsaan Strawder remains in custody on a $1,000,000 (10%) bond. State’s Attorney Runty filed a Motion to Collect DNA from Mr. Strawder and the Motion for Collection of DNA was approved by Judge Daulton on March 29, 2023. Defense Attorney Lance Camp said his client had no objection to the motion. State’s Attorney Runty will let the Law Enforcement Agency know they can work with the Henry County Sheriff’s Office to collect a DNA swab. Mr. Strawder is charged with 2 counts of First Degree Murder (Class M Felony), 2 counts of Aggravated Batter to a child under 13 (Class X Felony) and Aggravated Battery (Amended to Class 3 Felony). Michael Lindquist: Michael Lindquist remains in custody on a $150,000 (10%) bond. Michael Lindquist had a Motion Hearing to Reduce Bond on March 29, 2023. Michael Lindquist testified at his Motion hearing on Wednesday and said that he knows he has a substance abuse problem and is ready to seek help at a Rehab and Mental Health Facility he found in Pekin, Illinois. As part of the sentencing on a previous case, Lindquist was ordered to see Substance Abuse treatment, but he did not seek treatment at the time. Judge Terry Patton denied the Motion to Reduce bond because Mr. Lindquist didn’t seek treatment when ordered and said Mr. Lindquist needs to be present in court to clear out his pending cases and the two cases awaiting sentencing. Michael Lindquist said he intended to live about two blocks from the courthouse, if released, where he basically has lived his whole life . Mr. Lindquist had a job prior to his incarceration but is currently unemployed. Michael Lindquest said he is ready to seek treatment and found a facility in Pekin that has a room for him. He said he would enter the facility immediately following his release, should he be released, and his mother testified that she would take him to the facility immediately. Michael Lindquist said “I grew up here, this is my home” in regards to State’s Attorney Runty asking him about his criminal history. Lindquist said he is not a violent person. Defense Attorney Camp said his client has done the legwork to get into a facility and has been accepted into the facility. Mr. Camp said his client acknowledges that he needs to go to a rehab facility and he has a ride to the facility immediately following his release. Mr. Camp said his client as a variety of projects waiting for him outside of the jail and he can walk to court since he will only be a couple blocks from the courthouse. Mr. Camp requested the bond be lowered to a $5,000 recognizance bond. State’s Attorney Cathy Runty objected to any recognizance bond of any amount. State’s Attorney Runty said “I don’t doubt that Mr. Lindquist has a substance abuse problem”. State’s Attorney Runty said she has no doubt Mr. Lindquist needs substance abuse therapy but she does doubt his ability to come back to court. A Jury Trial was scheduled for April 4th but the two parties have agreed on a partially negotiated plea. A plea hearing is scheduled for Monday, April 3, 2023, at 11 AM. Read more here.

Lindquist is charged with Possession of a firearm by a Felon (Class 3 Felony), Possession of Meth <5 grams (Class 3 Felony), Resisting Peace Officer (Class A Misdemeanor), Flee to Elude (Class A Misdemeanor), Driving on Revoked License (Class A Misdemeanor), plus traffic violations for case 22CF355. The State dismissed the two Class X Felonies for case 22CF255 in January. Lindquist is charged with Driving on a Revoked/Suspended License from a DUI (Class 4 Felony) and Driving on Revoked License (Class A Misdemeanor) for case 22CF69.

William Borsch: William Borsch remains in the Henry County Jail on a $200,000 (10%) bond. William Borsch requested a Bond Reduction Hearing to allow him to enter a rehabilitation program at the One Eighty Rehabilitation Center. Attorney Breedlove said that Mr. Borsch had been accepted into the program but he doesn’t have the funds to bond out to enter the facility. Attorney Breedlove said they are not asking for Mr. Borsch to be released with free reign. Assistant State’s Attorney (ASA) Reynolds argued that Mr. Borsch has four pending felony cases, some are violent offenses. ASA Reynolds said that Mr. Borsch has been drug free while in the custody of the Henry County Jail. Attorney Breedlove said Mr. Borsch has responsibilities in the jail because of his good conduct and requested Mr. Borsch be released on conditions to attend the program. Judge Colby Hathaway denied the Motion to Reduce Bond because of the violent nature of the charges and there are no conditions that could ensure the safety of the victims. A Jury Pre-Trial is scheduled for April 20, 2023, at 1 PM. Borsch is charged with Aggravated Battery of a Child under the age of 13 (Class 3 Felony), Possession of Heroin 15-100 grams (Class 1 Felony), and Possession with the Intent to Deliver 15-100 grams of Heroin (Class X Felony) for case 2022CF44. Theft <$300 (Class 4 Felony) and Theft (Class A Misdemeanor) for case 2021CF394. Obstruct Justice/Destroy Evidence (Class 4 Felony) and Violation of Bail Bond (Class A Misdemeanor) for case 2022CF54.
