Geneseo Man Decides on A 402 Conference Instead of Scheduled Plea

John A DeBord from Geneseo was told by his attorney that he didn’t need to attend his scheduled Plea Hearing on April 14, 2023, because Plea negotiations fell apart and he wants a 402 (d) Conference now.  Attorney Breedlove attended the Plea hearing by telephone and said there was a misunderstanding when he told his client that he didn’t need to attend the scheduled hearing.  Mr. Breedlove said that plea negotiations have reached an impasse.  The victim in this case is a minor and the State’s Attorney needs to speak with the victim regarding a 402 Conference.  Because the victim is a minor and DeBord has a Juvenile conviction, the 402 conference will be closed to the general public.  A 402 Conference is scheduled for April 27, 2023, at 9 AM.  Judge Terry Patton told Mr. Breedlove that only the court can excuse a defendant from a hearing and that Mr. DeBord’s presence is required at the 402 Conference.
