Nicholas Smith, 22, of Kewanee accepted a plea deal on February 2, 2023, that sends him to the Illinois Department of Corrections (IDOC) for 2 years. Smith plead guilty to Count 1 of Aggravated Battery causing Great Bodily Harm and Count 3 of Violation of Protection Order. Smith received 2 years in IDOC with day-for-day credit, 6 months Mandatory Supervised Release, credit for time served and fines and assessments for Count 1. For Count 2, Smith received 364 days in the Henry County Jail with day-for-day credit and credit for time served. Count 2 will merge withe the IDOC sentence. Smith must report to Court Services within 30 days of release to set up a payment plan for fines and assessments.
Nicholas Smith was arrested on November 22, 2022, after he stabbed his uncle during an altercation in the 100 block of N. Jackson Street. Richard Trimmer, who was arrested and charged with Domestic Battery, confronted his sister in a bedroom in the residence over her dog defecating on a garden hose. Nicholas Smith grabbed what he thought was a knife and stabbed his Uncle, Richard Trimmer, during the confrontation. The weapon was actually scissors and Trimmer refused treatment on scene.
