Preliminary Hearings from June 12, 2023

Carlos Bonilla:  Carlos Bonilla, 31, of Kewanee remains in custody on a $50,000 (10%) bond.   Bonilla waived his Preliminary Hearing and Formal Arraignment.  A Jury Pre-Trial is scheduled for July 13, 2023, at 1 PM.  A Motion to Reduce Bond or Release on Own Recognizance was filed on June 7th and a Motion hearing is scheduled for June 16th at 10:50 AM.  Carlos Bonilla is charged with Robbery (Class 2 Felony), Battery/Makes Physical Contact (Class A Misdemeanor) and Battery/Cause Bodily Harm (Class A Misdemeanor) for case 23CF139.

Juan Montemayor:  Juan Montemayor, 31, of Kewanee appeared in court for a Preliminary Hearing, which was originally scheduled for June 27, 2022.  A Drug Enforcement Agency (DEA) agent from the DEA Chicago Division was on surveillance duty during the controlled buy of Fentanyl pills in 2022 in Kewanee that led to the arrest of Juan Montemayor.  Agent K testified that a Confidential Source arranged to buy 10,000 Fentanyl pills from Montemayor.  The Confidential Source provided a phone number to agents for Montemayor and was provided a handler by the DEA.  According to testimony, an undercover DEA Agent contacted the defendant to arrange the controlled buy.  Agent K testified that Montemayor met with the undercover officer and arranged to met later with the fentanyl pills.  The pills field-tested positive for Fentanyl and are made to resemble controlled substances like Oxycontin, according to Agent K.  The total weight of the pills is 1035 grams.  The transaction was recorded and Agent K believes the recording clearly shows the defendant but he would need to review the video evidence to be certain.  A handgun was found in the vehicle with the defendant and Montemayor does not have a FOID Card.  Judge Terry Patton found probable cause and a Jury Pre-Trial is scheduled for July 13, 2023, at 1 PM.   Montemayor is charged with Manufacture/Deliver 900+ Grams Fentanyl (Class X Felony), Possession of a Gun by a Felon (Class 3 Felony) and Aggravated Unlawful Use of A Weapon (Class 4 Felony) for case 2022CF188, Aggravated Battery/Public Place (Class 3 Felony) and Battery/Makes Physical Contact (Class A Misdemeanor) for case 2021CF340 plus various driving violations.

Luke Washburn:  Luke Washburn, of Kewanee remains in custody on a $100,000 (10%) bond.  Washburn waived his Preliminary Hearing and Formal Arraignment.  A Jury Pre-Trial is scheduled for July 13, 2023, at 9 AM for all open cases.  Washburn is charged with Obstruct Justice/ Leave State (Class 4 Felony) and Resisting (Class A Misdemeanor) for case 22CF147, Obstruct Justice/Leave State (Class 4 Felony) for case 22CF291, Possession of a Firearm by a Felon (Class 3 Felony) and Possession of Meth <5 Grams (Class 3 Felony) for case 22CF41 and Possession of a Firearm by a Felon (Class 3 Felony), Possession of Meth <5 Grams (Class 3 Felony), Mfg/Distribute Look alike Substance (Class 3 Felony), Criminal Trespass to Residence/ Persons present (Class 4 Felony) and Possession of Look Alike Substance (Class P Other) for case 23CF137.

Dale Livingston:  Dale Livingston, 53, of Kewanee is charged with pushing his mother down causing injuries on June 5, 2023.  Officer Austin Stroud testified at the Preliminary Hearing that Dale Livingston was arrested on June 7th for battering his mother, who is 60 years of age and older.  Mr. Livingston told Police that he hit his mother with his arm as he was opening a window, his statements to police were recorded.  His mother told police that Dale had pushed her, causing her to fall and hit a chair.  The bruises on Ms. Livingston were photographed by Officers.  Judge Terry Patton found probable cause and a Jury Pre-Trial is scheduled for July 13, 2023, at 9 AM.  Livingston is charged with Aggravated Battery/Victim 60+ (Class 3 Felony) and Domestic Battery/1-2 Prev Convictions (Class 4 Felony) for case 23CF145.
