Javon Porter: Javon Porter, 36, of Chicago remains in custody of the Henry County Jail. Porter waived his Preliminary Hearing and Formal Arraignment. A Jury Pre-Trial is scheduled for November 9, 2023, at 9 AM. Judge Zimmer found there is no material change in circumstances since the initial hearing so defendant will remain in custody. Porter is charged with Attempted Murder (Class X Felony), Possession of a Firearm by a Felon (Class 3 Felony), Reckless Discharge of a Firearm (Class 4) and two counts of Aggravated Battery with a Firearm (Class X Felony). Michael Workheiser: Michael Workheiser remains in custody of the Henry County Jail. The Preliminary Hearing for Michael Workheiser had to take a recess so the Judge and Attorney’s could research probable cause determination after Judge Zimmer found probable cause on one count of the three counts for the case. Inspector Kellen Daniels testified that on October 3, 2023, he witnessed a controlled purchase of five guns in Bishop Hill by a Confidential Source. Inspector Daniels is a Kewanee Police Officer assigned to the Black Hawk Area Task Force. The Confidential Source (CS) was in contact with Michael Workheiser to purchase multiple guns for $1,500. The defendant approached the CS with a duffel bag and the CS gave the $1,500 to the defendant. Following the transaction, the defendant was seen leaving the scene. A traffic stop was conducted on the vehicle for a lane violation. During a search, a small bag of a substance that field tested positive for methamphetamine and the $1,500 was found on the defendant. The CS was searched prior to the exchange and had no drugs on his person to have supplied the meth in the defendant’s possession. Initially, Judge Zimmer found probable cause on Count 3 for Possession of Meth but found no probable cause on the Possession of Weapons by a Felon and Possession of Firearm with Defaced Serial Number. Judge Zimmer said there was no testimony regarding the firearms in the defendants possession and defaced serial numbers. State’s Attorney Runty requested the opportunity to get case law regarding Probable Cause to argue that probable cause found on one charge applies to all charges for the case in discussion. After finding case law, Judge Zimmer reversed his decision and found probable cause on all counts. A charge of Possession of Meth, in and of itself, is not a detainable offense, but the firearm charges are detainable. Judge Zimmer said there was no material change to the circumstances from the initial hearing and ruled that the defendant remain in custody. The Defense said they have filed an appeal on the detention ruling. A Jury Pre-Trial is scheduled for October 12, 2023, at 1 PM. Workheiser is charged with Possession of a Firearm by a Felon (Class 3 Felony), Possession of a Firearm with a Defaced Serial Number (Class 3 Felony), and Possession of Methamphetamine (Class 3 Felony).
